Can CAF Punish Dieumerci Mukoko After Orlando Pirates Controversy?

Orlando Pirates supporters are furious after Saint Eloi Lupopo’s Dieumerci Mukoko avoided punishment for his misconduct during the CAF Champions League second preliminary round, second-leg tie at Orlando Pirates Stadium on Saturday. Mukoko, notorious for gamesmanship, repeatedly unsettled Pirates throughout the match. The situation escalated before half-time when he head-butted Masindi Nemtajela, prompting Tshepang Moremi to retaliate with a shove. The referee mistakenly red-carded Chris Sumbu Maniania of Lupopo along with Moremi, while Mukoko remained on the pitch. His unsporting behaviour continued in the second half, even as Lupopo eventually progressed to the group stage via a 5-4 penalty shootout after a 3-3 aggregate draw, despite losing 3-0 on the night.

CAF regulations allow for cases of mistaken identity, as outlined in Article 39. While the disciplinary body cannot intervene in referees’ interpretation of the Laws of the Game or incidents they miss, administrative errors such as wrong red cards can be corrected. Clubs can submit evidence, including video footage, to prove inaccuracies in match officials’ reports.

The appeals process requires affected parties to notify CAF of intent to appeal within three days of the incident and submit a full petition within seven days. A $3,000 deposit (R51,667) must accompany the petition, refundable if the appeal is successful. Evidence must clearly demonstrate the referee’s administrative mistake, shifting the burden to the club challenging the decision.

CAF regulations state that an assault on an opponent carries a three-match suspension, while serious foul play results in a two-match ban. If Pirates or any affected party files an appeal successfully, Mukoko could face a suspension ruling him out of Lupopo’s first three group stage matches.

It remains unclear whether Orlando Pirates will pursue the matter. Fans and analysts alike are watching closely, as CAF’s response could set a precedent for how mistaken identity and unpunished misconduct are addressed in the competition.
